The court of additional chief Judicial Magistrate VII had rejected the surrender application of the driver on Wednesday in the case. Also read: 25-year-old woman travelling in e-rickshaw crushed to death after drunk cop’s car rams vehicle In an application filed by Shivam Mishra’s lawyer, it was claimed that on the day of the incident, the car was being driven by Shivam’s driver, Mohan M., a resident of Dwarka, Delhi. The police report submitted in court stated that Mohan was not an accused in the case. The investigation so far has revealed that the car was driven by Shivam Mishra on the day of the accident. While claiming to accept responsibility for the crime on behalf of Mohan, his lawyer also presented an agreement dated February 8 between the complainant, Mo. Taufiq, and Mohan in court. It stated that an agreement had been reached between the two. Mohan paid for the medical treatment expenses, with which Mo. Taufiq was satisfied and did not want to take any further action. The agreement also stated that it was made without any pressure. Also read: Kanpur Lamborghini crash: ‘He was not driving the car, wrongly arrested’ says Shivam Mishra’s lawyerThe prosecution argued that since Mohan’s name was not even mentioned in the case, there was no need for him to surrender. After hearing both sides and reviewing the police report, the court rejected Mohan’s surrender application.Regarding the application for the return of the accident-damaged car from the police station to the owner, the court sought a technical examination report from the police. An application was also filed in court by the car owner’s lawyer seeking the release of the Lamborghini. The police stated that a technical examination of the car would be conducted by the RTO, upon which the court ordered the car owner to show the vehicle documents to the investigating officer and directed the police to submit the technical examination report to the court.“Driver Mohan was driving the car. The agreement was also shown in court, but police are wrongly implicating Shivam. Based on the police report, the court has rejected Mohan’s surrender application. We will file a revision petition in the District Judge’s court against the order,” said Dharmendra Singh, Mohan’s lawyer.
