Walterboro, South Carolina (FOX Carolina) – Alex Murdau’s legal team filed a motion Monday asking the court to exclude or limit some of the firearms identification evidence and testimony by state ballistics experts.
Motions from the defense were filed on the first day of jury selection and focused on the .300 Blackout cartridge found at the crime scene and the testimony of state ballistics expert Paul S. Greer, who examined evidence in the case. was
According to the motion, law enforcement fired around Maggie Murdau’s body, on the ground near the entrance to the side of the house on the Moselle property (about 300 yards from the crime scene), and in an area by police. Greer was unable to conclude that the casings found near Maggie Murdau’s body were fired from the same gun, but the characteristics identified indicate that the casings had been loaded and pulled at some point. It reported that it had been pulled out, indicating that it had been ejected.
The motion argued that Greer’s conclusions were not based on scientifically valid or reliable methods. The allegation went on to add that the danger of unfair bias and the risk of confusing or influencing jurors outweighed the value the testimony would bring to the trial.
The motion also suggested that courts could hold council hearings to determine whether testimony should be removed or restricted.
